Bill Cosby's Rape Accuser Denies Making Up Claims


The defense plans to call Jackson as a witness and says she will testify that before Constand lodged her allegations against Cosby in 2005, Constand had mused to her about setting up a "high-profile person" and filing suit.

Constand, who stepped down from the stand Monday, says that though Cosby "came on" to her before the alleged assault - putting his hand on her thigh and once trying to unbutton her trousers - she stopped him and they never shared any consensual sexual contact.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.

Cosby, 80, has denied any acts of non-consensual sexual activity.

Cosby's first trial ended in June when a different jury deadlocked on all charges after more than 50 hours of deliberations. They argued to the court, the statements are irrelevant because there is no evidence Cosby gave Constand the now-banned drug.

Bliss then attempted to show that Gianna Constand did not know everything going on in her daughter's life, and therefore wouldn't know if she was "having an affair" with Cosby.

Allred, who attended the first trial, also has been attending the retrial, sometimes getting into arguments outside the courthouse with Cosby's bombastic spokesman, Andrew Wyatt, who calls her "Gloria Awfulred". In his interview with police, Cosby refuted Constand's claim that he only touched her sexually once, saying they'd had sexual contact three times, including at Foxwoods Casino in CT. He says the sexual encounter was consensual.

Defence attorneys on Monday sought to undercut Constand's credibility, pressing her about accusations that she had schemed to plant a false story of abuse to reap hush money.

The comic ultimately settled Constand's lawsuit for almost $3.4 million. And, you know, now he's trying to convince the jury that it is also true of Cosby's main accuser, Andrea Constand. She said he described how he had touched Andrea Constand's breasts and vagina and guided her hand to his penis.

Andrea Constand told jurors she doesn't "recall ever having a conversation with" Marguerite Jackson. The evidence backed testimony from Constand, who said she likely was returning calls from him about Temple women's basketball.

Constand was more confident and composed as she told jurors about the night in question.

The ACLU is pushing US lawmakers to enact broad privacy legislation including a requirement for consent prior to data collection. The updates will be rolled out globally over the next two weeks.

At one point on Friday, Constand told the court, "I was very scared".

Further, O'Neill also declined to allow the defense to tell the jury about dueling lawsuits between Constand and Castor.

Sporting a dark hairstyle of twists, a pearl necklace and wearing diamond stud earrings, Traylor said she was horrified over a protester who jumped a barrier, stripped off her shirt and bra and ran in front of Cosby. The former Temple University women's basketball administrator accused Cosby of drugging and molesting her at his suburban Philadelphia home in 2004. But Constand's phone records show she did not make any calls to Cosby's mansion that month.

She has testified that she saw Cosby as a mentor and had no romantic interest in him.

Prosecutors have called to the stand five other women who said Cosby drugged and assaulted them, too. Lili Bernard and Victoria Valentino (both say they were drugged and raped by Cosby years ago) have been attending the trial. Meanwhile, there was a surprise announcement from presiding Judge Steven O'Neill.

District Attorney Kevin Steele brought criminal charges in late 2015, days before the statute of limitations for the crimes was due to expire.

The jury at Cosby's first trial deadlocked on the charges.

Cosby's convoluted definition of consent was on display for the jury when his testimony from a 2005 deposition was read to them Tuesday: In it, Cosby described reaching an area "somewhere between permission and rejection" during what he claimed was a prior sexual encounter with his chief accuser, Andrea Constand.

Cosby's words underscore the he said, she said nature of the case of Commonwealth of Pennsylvania v. William Henry Cosby Jr. - as the case against the entertainer is formally captioned.
